Terms of Service

These Terms of Service (“Terms”) are between AutoHound, LLC (“AutoHound,” “we,” “us”), an Austin, Texas company, and the business that subscribes to the AutoHound service (“you,” the “Shop”). By creating an account or using the service at portal.autohound.io (the “Service”), you agree to these Terms on behalf of your business. These Terms replace the AutoHound End User License Agreement and the separate Billing and Subscription Terms, and combine both into one document.
1. License and access
Subject to these Terms and payment of applicable fees, AutoHound grants you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business operations during your subscription. You may not resell, sublicense, copy, modify, or reverse-engineer the Service, or use it to build a competing product.
2. Accounts
You are responsible for the accounts you create for your staff, for keeping credentials and PINs confidential, and for all activity under your accounts. You will promptly deactivate accounts of personnel who leave your business and notify us of any suspected unauthorized access.
3. Your data
Your business records in the Service, including customers, vehicles, repair orders, estimates, insurance claims, parts and purchase orders, technician time records, photos and documents, messages, signed intake forms, and payment records (“Shop Data”), belong to you. While your subscription is active, an Owner can export your business records at any time from Settings, and can export your photos and documents from Settings as well. The photo and document export is a set of download links covering every photo and document attached to your repair orders, and AutoHound includes a downloader that saves those files onto your computer, one folder per repair order. The links stay usable for 72 hours after you create the export, and you can create a new export whenever you need one. If your browser cannot save into a folder you choose, you can still download the list of links and use them yourself. Picture messages your customers text to you are stored with the message thread and are not part of that export. You grant AutoHound the rights needed to host, process, back up, and display Shop Data solely to provide the Service. Our handling of personal information is described in our Privacy Policy. You are responsible for the accuracy and lawful collection of the data you put into the Service, including your customers’ consent to be contacted.
To provide support, a limited number of authorized AutoHound personnel can access your account, including by signing in as one of your users in order to see what that person sees and reproduce a problem. We record the start of every such session in your shop’s own audit records, which an Owner can export from Settings at any time.
4. Data retention
While your subscription is active, we keep your Shop Data available to you, and we may keep each record for up to 7 years from the date it is created. Repair, payment, and warranty history is often needed years after a vehicle leaves the shop, and 7 years is the outside horizon we plan around for a live account. This is not a period we hold your data after you leave: Termination and data deletion, below, covers that.
Once a record is more than 7 years old, we may delete it at any time and without notice. We reserve that right rather than promise it: nothing here obliges us to keep a particular record for the full period, to delete it at the end of one, or to tell you before we do either. Export what you need while you have access, as described in Your data and in Termination and data deletion.
Shorter and longer periods both apply in places. Some working records are cleared much sooner: sign-in sessions within days of expiring, in-app notifications after about 90 days, routine activity-log entries after about a year, messages your staff send each other inside AutoHound after about two years, and photos attached to a repair order you void after about 30 days. While your account is open, other records are kept longer than 7 years, and some indefinitely, because they are the evidence a later dispute turns on: proof that a customer agreed to be contacted and any later opt-out, payment and estimate records, signed authorization and delivery forms, the record of documents or photos that were deleted or altered, and the audit record of who at your shop or ours did what.
5. Text messaging
The Service can send SMS messages to your customers on your behalf. You are responsible for using messaging lawfully: obtaining consent, honoring opt-outs, and complying with the Telephone Consumer Protection Act and carrier requirements. The Service provides tools to record the consent you capture, and it automatically enforces STOP requests. It also applies quiet hours, which a user at your shop can override for an individual message. We record each override. The messages sent from your account are yours.
6. Third-party services and integrations
The Service interoperates with third-party products, including estimating systems (via file import) and Intuit QuickBooks Online (via a connection you authorize). When you connect an integration, you direct AutoHound to exchange the relevant data with that provider on your behalf, for example, invoices, payments, and customer records with QuickBooks. Third-party products are governed by their own terms and privacy policies, and AutoHound is not responsible for them. You may disconnect an integration at any time in Settings. QuickBooks and Intuit are registered trademarks of Intuit Inc.; CCC ONE, Mitchell, and Audatex are trademarks of their respective owners. AutoHound is not affiliated with or endorsed by these companies.
7. Subscription and fees
A subscription covers one shop location. A business operating several locations subscribes for each. Subscription fees are billed per location at the rate shown when you subscribed, plus any applicable taxes.
A subscription bought on our website starts with a 30-day free trial. A payment method is required, and you pay $0 when the trial begins. Before you confirm checkout, our payment provider shows you the exact date your paid subscription will begin. Cancel before that date and you are not charged for the subscription.
A subscription bought on our website is billed monthly. Your subscription renews automatically at the start of each billing period until it is canceled, and the subscription price plus any applicable taxes is charged to the payment method on file at the beginning of each paid billing period.
Fees for a founding-shop or promotional rate remain as agreed in writing.
AutoHound does not charge setup fees. If you ask us for a custom historical-data import or migration, we will define the scope and give you a separate price for your approval before that work begins.
8. Multi-location groups
Shops operating as a group can be billed together. Group billing is arranged with our team and is not available through self-service signup.
The group is billed as a single subscription carrying one line item per member location, and the locations are named on every invoice. The group, not each individual shop, is responsible for the invoice, and a shop billed through its group is not charged separately.
Adding a location during a billing period adds a prorated charge for the remainder of that period. Removing a location removes its line with a prorated adjustment. Removing the last remaining location ends the group subscription.
If a shop joining the group already has its own AutoHound subscription, we cancel that subscription with a prorated credit, and the group’s invoice takes over from that point. A shop that leaves the group returns to its own subscription at the price it held immediately before joining.
One billing period applies to the whole group. Individual locations cannot be on different periods, the period is set when group billing is arranged, and changing it later means contacting us.
A shop billed through its group does not manage or cancel that subscription from its own Settings, because it is not the shop that is billed. The group arranges changes with us, and a shop leaving a group is covered above.
9. Price changes
We may change subscription prices. We will give at least 30 days’ notice by email to the billing contact on the account, and the new price takes effect at the start of your next billing period after that notice. If you do not want to continue at the new price, you can cancel before it takes effect, and your current price applies through the period you have already paid for.
10. If a payment fails
If a payment fails, we retry it over the following days, and the account’s Owner sees a notice in AutoHound with a link to update the card. Your shop keeps working. A failed payment does not lock anyone out, and your staff are not shown the shop’s billing status.
If a balance remains unpaid after we have tried to reach you, we may suspend access until it is settled, and we will contact you before we do. A suspension pauses sign-in and does not delete your records. Suspension is described in Suspension, below.
11. Cancellation and refunds
You can cancel at any time. An Owner cancels from Settings, under Billing, which opens our payment provider’s billing portal, or you can ask us at [email protected] or (888) 477-0652. Cancellation takes effect at the end of the current billing period, and your access continues through that date.
Where a shop has arranged a longer billing term in writing, cancellation takes effect at the end of that term, and the written arrangement governs any refund.
A shop billed through a group cancels through the group rather than on its own, as described in Multi-location groups.
Otherwise, subscription charges are not refunded, and unused time is not refunded when you cancel, except where the law requires it.
Proration applies to changes made during a billing period: adding or removing a location from a group is prorated, so you pay only the difference for the remainder of that period.
12. Termination and data deletion
These Terms run while your subscription is active. We may terminate for material breach that remains uncured 15 days after we notify you. Termination is the remedy we cannot undo, which is why it carries the longer period: a suspension, which is reversible, is described in Suspension, below.
Export your Shop Data before your access ends, including your photos and documents, which an Owner exports from Settings as described in Your data. While your subscription is active you can do all of this yourself, and we recommend doing it well before you cancel. Access to the Service ends on termination, and after termination we do not provide exports. We have no obligation to retain, restore, or provide Shop Data, and it may be deleted at any time. Deletion cannot be reversed.
We then remove your Shop Data from our active systems within 90 days of your access ending, subject to any legal obligation to keep something. Copies held in our encrypted backups expire on our normal backup schedule, within 30 days after that. We do not hold your business records for years once you have gone: the 7-year period in Data retention applies to records in an active account and is not a period we keep your data after you leave.
We do not keep your business records once you stop paying for the Service. Where the law requires us to retain something, for example records of consent for messages we sent on your behalf, or our own billing and tax records, we keep only that, only for as long as we are required to, and we use it for nothing else. The longer retention described in Data retention applies while your account is open.
13. Acceptable use
The Service is for running your repair business. You agree not to use it, and not to let anyone using your accounts use it, to:
- break the law, or store or send content that is unlawful;
- send messages to people who have not consented to hear from you, or who have asked you to stop, or otherwise send messages in a way that breaks the rules described in Text messaging;
- send messages unrelated to repair work you are doing or have done, such as unsolicited advertising to a purchased list;
- upload software intended to cause harm;
- attempt to reach another shop’s data, test the security of the Service without our written permission, or interfere with the Service’s operation; or
- store material unrelated to your repair business.
14. Suspension
We suspend access for two reasons: an unpaid balance, and use of the Service in a way Acceptable use forbids. An unpaid balance is handled as described in If a payment fails, and we contact you before we suspend.
If we become aware that your account is being used in a way Acceptable use forbids, we will tell you what we have seen and give you 7 days to put it right. If it is not put right in that time, we may suspend your access until it is. Where we can address the problem by pausing one part of the Service rather than all of it, for example your outbound text messaging, we will do that instead of a full suspension.
The 7 days apply to suspension, which we can undo. The 15 days in Termination and data deletion apply to termination, which we cannot.
We may suspend access immediately, without that notice period, where we believe in good faith that it is necessary because of unlawful content or unlawful use of the Service, a threat to the security of the Service or to other shops’ data, or conduct that puts our standing with mobile carriers at risk. Messaging is delivered under registrations that cover every shop on the platform, so conduct that jeopardizes them affects businesses other than yours, and we will act quickly to protect them. We will tell you promptly after we suspend, and why.
A suspension pauses access. It does not delete, alter, or hand over your Shop Data, and your records remain exactly as they were. Termination, export, and deletion are governed by Your data and by Termination and data deletion, and nothing in this section changes them.
While your access is suspended you cannot sign in, so you cannot run the exports described in Your data yourself. Ask us at [email protected] and we will either restore your access long enough for you to export your Shop Data or send you a copy of it. A suspension is not a reason for us to withhold your records from you.
If you resolve what caused the suspension, tell us and we will restore your access. Where the cause is something you can fix, we will say plainly what would resolve it. If we conclude the account cannot be reinstated, we will tell you that instead, and Termination and data deletion governs what happens next.
We do not review the content you store or the messages you send, and nothing in this section obliges us to. We act on what is reported to us or otherwise comes to our attention.
15. Disclaimers
The Service is provided “as is” and “as available.” AutoHound disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Service supports your business operations but does not provide legal, accounting, or insurance advice, and you remain responsible for your business records and filings.
16. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and AutoHound’s total liability under these Terms is limited to the fees you paid for the Service in the twelve months preceding the claim.
17. Indemnification
You will defend and indemnify AutoHound against third-party claims arising from your Shop Data, your use of the Service in violation of these Terms, or your violation of law, including messaging without required consent.
18. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date, and continued use of the Service after the effective date constitutes acceptance. We will not reduce your data-ownership or export rights without your consent.
19. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflicts of law. Exclusive venue for disputes is the state and federal courts located in Travis County, Texas.
